Ive worked with Barry on a few issues as a business owner and could not be happier with his ethics, his insight and his help. The last issue, we unfortunately had to seed legal counsel for an ex employee who was trying to sue us for something that just did not happen. Barry! My former employer sued me for violating my non-solicit agreement and got a TRO. Then, I hired you and everything changed. You put a plan in place, executed the plan, and had the case mediated and settled under very favorable terms within two weeks. You rock and I appreciate all you did for me. During the entire process of my non-solicit case, you reduced my anxiety and made me feel like I was a priority and had my back. In the mediation, you would not stand for anything that was not in my best interest. Even if it meant we wouldn t reach a settlement at mediation, you weren t going to allow the case to settle unless I was getting the better end of the settlement. Mr. Hersh saved my staffing firm from EEOC Charge when every other lawyer I contacted in Dallas and Houston gave up saying negotiation was the only solution. In recently, we were in this fix where a person filed this untrue complaint at eeoc. I have contacted about 12 lawyers including the one with asking top dollar in fees, went through lot of websites, reviews and had multiple discussion meetings, spent weeks and no one were able to give any satisfactory resolution or suggested the right way. Thing about Mr. Hersh is that he can t be connected directly via phone for case discussion like some other firms, One must have patience and fill his form with details over website then he connects and understand the case before he gives his time to talk to you and that is how I knew he was the right person as he had satisfactory plan to pursue this and we decided to go with him. Once committed he was quick in response via email or phone or text, he answered all my questions and made me feel confident during this stressful time. Finally, Mr. Hersh got us out with right way and ethics and this literally brought tears to my eye the day he emailed about dismissal of charges on the case. I was in a terrible position, living in a state where I didnt know anybody, had no support, and had no legal referrals after the company I came here to work for decided they didnt want me to work for them anymore. I had never had a legal battle with anyone in my entire life, let alone my employer before this. Apparently, Karma was on my side because I chose Barry Hersh to represent me in a breach of contract case. This was a very painful and emotional experience for me and Barry was very sensitive to that and let me be unreasonable at times when I think others may have told me to stop being unreasonable! He was able to learn a great deal of information about my industry to understand what had really happened to me and why, therefore, recognizing the gross behavior of my employer. He negotiated an excellent settlement for me but just as important, was always on my side and showed a great deal of empathy for what I had experienced. I spent most of my career as a paralegal in intellectual property, insurance defense, and family law, working for board certified attorneys. Accordingly, I am very knowledgeable about what someone should be looking for when choosing an attorney. There are many smart attorneys in the Dallas area, and Barry is definitely one of the best employment attorneys that you will find. I say this as someone who has now used his services twice. But the HUGE difference between Barry and other attorneys is that he only takes on cases that he can give 100%. If he takes your case, he will work it. If he tells you that he will do something, he will do it. I really cannot stress how important this is. An attorney who takes on more work than he can manage is not who you need. Michael M. Breached Severance Agreement (exceeding $300,000 claim). As CEO of a high tech firm, I transitioned in a new CEO and established a Wages and Settlement Agreement with the firm upon my departure. The firm breached the contract and I had to protect my interests. I researched attorney s that would have the right legal background, right personality, top legal rankings, and proven successes to bring my lawsuit to. In mid May of 2019 I retained the services of attorney Barry S. Hersh for an overtime wage dispute with my former employer. After being told by the Dept of Labor that I was due over time wages, but that their case load was too large to help, I contacted several attorneys. I was turned down by all the other attorneys except Barry Hersh. He did his homework and gathered information about my situation instead of turning me down, like everyone else.
