I had a consultation here for a K-1 Visa for my Mexican fiancée and unfortunately I was disappointed with how it went. According to the lady I spoke with, there were two options on the table. The regular K-1 Visa process which is famous for taking a long time, at that time it was about 15 to 18 months before my fiancée would be able to cross. The second option, which the lady said was easier and quicker was an adjustment of status. When I asked her what that was the lady told me that my Mexican fiancée could cross into the US using her tourist visa and we get married here in the US at any moment we wanted, then adjust her status after the marriage, tourist visa to permanent resident. Well, I had already done my own research, and I knew in that moment that the process she was explaining was illegal and would probably result in the deportation of my fiancée, now wife (if I follow through with her process) without any recourse. I do understand why she would recommend that path though, because it was a process many people used for many years without any issues, but since 2016 the US Government no longer looks over this loophole. That s what an adjustment of status with a tourist visa is, a LOOPHOLE. The problem with the adjustment of status process is the stipulations on her tourist visa which don t allow her to do anything but visit the US for a short amount of time with the understanding that she must return to her home country at the end of her trip. The first issue comes from the fact that she would essentially have to lie to the border agent about why she s crossing into the US because if she told a border agent she was crossing to get married and present her tourist visa, they would turn her back to Mexico immediately. So with that one lie she could get into the US and we can get married, but it all really comes to a head once we submit the adjustment of status. The US government would see two issues, first and most obvious is that she crossed with a tourist visa and got married, strike one, the second is that she lied to a border agent about her reason for crossing, strike two. And this isn t baseball, so with that my new wife would be deported, and to my knowledge there is no recourse after this. No bueno if you ask me. This is literally why the K-1 Visa exists, it s a visa that allows someone from another country to get married to an American citizen in the United States. Also, I met a very kind man in the waiting room and we got to talking, and he was saying the price he was quoted was not at all what he has ended up paying, that many times there were new issues that required more and more money. He told me to go elsewhere, and I m here to tell you the same. At the very least, DO YOUR OWN RESEARCH. Don t just blindly accept what someone who is a lawyer says simply because they are a lawyer. UPDATE: I m very pleased state now that my fiancée and I have completed the K1 visa process and are now husband and wife, and we did so completely on our own and without paying one cent to a lawyer. It can be done, very easily in my opinion, just read the instructions on the USCIS website throughly and follow them to a T and look up any questions you have on Google or YouTube. It s really not that hard. It will save you an arm and a leg on a process that is already very expensive! Filing form I-485 tomorrow. God bless you all.
