I am Frances Damon Briggs; Attorney Harter, every single word of my review regarding you is true, and you know it. You stated that you got me everything I wanted and more. Name at least One (1) asset from my 27 years of marriage that you got me? ... You cant. You did no one a favor. You even gave my former husband assets which Attorney Frank Shor had gotten me, as my marital property before he passed away. It was not the terms of the Plan which prevented my payment under your prepared QDRO. It was the terms of your prepared QDRO which prevented my payment. That tax-qualified Plan is subject to Section 414(p) of the IRC, which governs the ASSIGNMENT of marital pension assets in a dissolution of marriage. According to the terms of the Plan, the early retirement age is age 55. My former husband was 57. According to the terms of the Plan benefit payments to a former spouse under a QDRO (me), begin the earliest date that the Participant is eligible to receive a payment from the Plan (if permitted by the QDRO) (Even if he had not received a payment). Section 414(p)(4)(A) of the IRC provides for distribution to the Alternate Payee as soon as the Participant reaches the Earliest Retirement Age under the Plan (again, which is age 55). Further, according the terms of your prepared QDRO I would have never received a penny because, you did not include the federal QDRO requirements. How could an attorney with over 38 yrs of practice, forget to include the federal requirements of a QDRO? Sir, the money from my former husbands Plan is all that I was to have (after you gave my other awarded assets to my former husband) I have been homeless, I have had to sleep in my vehicle, in neighbors homes and different family members, from couch to couch ... etc, all because you would not have the Order amended. I walked away with not even a Penny. So, I ask you again What did you get me? As far as paying you ... with what and for what? Are you saying that you did not get paid at all??... Sir, even your response to your reviews shows your true character. Instead of lying and becoming combative humble yourself, vow to do better, then do better. I understand that God is in control. I did not write the review out of some malicious intent. You are in a position to help people or hurt them. Be a person of Integrity. You left my son and I in a disaster and although my trust is in God, people need to know of your ethics. F.Y.I. I have not been blowing up your inbox. Maybe its your conscience. ~Regards
